Definitions and Interpretation

In these Terms of Service:

“We”, “us”, “our” and “Acomodile” are references to Acomodile Limited;

“You”, “He”, “She” or “User” mean a user of the Website or a person contacted us directly seeking Accommodation or any other Service, who should be of legal age in the country of origin;

“Website” means a website www.acomodile.com maintained by Acomodile Limited including without limitation the website at www.acomodile.ru, any associated social networking profiles and any applications for mobile devices that Acomodile Limited may publish from time to time;

“Accommodation” means a bed-space, study bedroom, studio or other house, flat or apartment offered through Acomodile by an Accommodation Provider;

“Accommodation Provider” means the provider of Accommodation listed on the Website or offered directly by Acomodile;

“Booking Request” means when a User makes a request to book Accommodation sending via the online booking system, telephonically, bank transfer, and electronic money or by handing in a signed and completed application form.

“Booking Confirmation” means the email sent by us to the User confirming the Users’ Accommodation, the Duration, Booking Fee (if applicable), Service Fee (if applicable), Payment Schedule and Acceptance of Booking Terms and Conditions;

“Deposit” means the Security Deposit and is payable when the User accepts the Offer. The Deposit will become security for the performance of the User’s obligations, and the discharge of the User’s liabilities, in the User’s contract for the Accommodation. The deposit will be returned after the User vacates the room minus any damages. Acomodile is not involved and shall not be liable for the management of deposits;

“Accommodation Contract” is a legally binding document between the Accommodation Provider (landlord) and you (tenant) and means the amount corresponding to the sum of all the rental payments for the duration of the contract with the Accommodation Provider. It sets out defined rules of the Property and the obligations of the landlord and tenant;

“Payments Schedule” means that the User must pay the Accommodation Fees either:
– (a) in full on or before the date for full payment specified in the Accommodation Contract; or
 – (b) in the instalments (if applicable) specified in the Accommodation Contract, on the Payment Dates.

“Installment Fee” means a single non-refundable payment of the amount specified in the Accommodation Contract, payable by the User if the User chooses to pay in installments;

“Services” means all those services provided through Acomodile and can be found on this website when the User requests the services, including without limitation the introduction of Users to Accommodation Providers. Any order for services made by the User from this website will be confirmed by email and we shall be under no obligation to provide services until such confirmation is received by the User. Requests are accepted at our sole discretion and we reserve the right to decline requests without giving any explanation.

“Service Fee” (if applicable) means the amount the User pays to Acomodile in respect of its fees when a Booking or any other Service is accepted.

“Acomodile Commission” is the fee that we charge the Accommodation Provider when a Booking occurs.

Acomodile uses cookies to improve the user experience on our website. We do not pass on or in any way collect personal information about you as an individual user.

Accommodation means a bed-space, study bedroom, studio or other house, flat or apartment offered through Acomodile by an Accommodation Provider;

Accommodation Provider means the provider of Accommodation listed on the Website or offered directly by Acomodile;

Booking Request means when a User makes a request to book Accommodation sending via the online booking system, telephonically, bank transfer, and electronic money or by handing in a signed and completed application form.

Booking Confirmation means the email sent by us to the User confirming the Users’ Accommodation, the Duration, Booking Fee (if applicable), Service Fee (if applicable), Payment Schedule and Acceptance of Booking Terms and Conditions;

2.4. You must be at least 18 years of age to use our website; and by using our website or agreeing to these terms and conditions, you warrant and represent to us that you are at least 18 years of age.

3.2. Bookings can be made for short or long terms starting from a couple of days to one year.

3.3. Acomodile operates as an advertising agent for Accommodation Providers and does not offer Accommodation to users on its behalf.

  1. Information displayed on the website

4.1. The Website contains information, images and prices of Accommodation as well as information relating to the location of the Accommodation and any other Services.

4.2. Acomodile tries to ensure that only accommodation that meets certain standards of cleanliness, furniture, building safety, finished facilities and customer service are offered to the User.

4.3. Acomodile strongly relies on Accommodation Providers to provide appropriate accurate information and to keep such information updated. Acomodile is not responsible for any errors, omissions or misleading statements on the Website.

4.4. Users of the Website are kindly advised to read any documentation carefully and ensure that they understand the cost of the Accommodation (i.e. the rent, deposit, services and any other costs), the term of the contract and any restrictions on the usage to which the Accommodation can be put.

5.1. You may:

(a) view pages from our website in a web browser;

(b) download pages from our website for caching in a web browser;

(c) print pages from our website;

(d) use our website services by means of a web browser,

(e) subject to the other provisions of these terms and conditions.

  1. Booking Accommodation

8.1. The User is able to make a Booking Request for Accommodation through the Website. The User should select the country, dates, budget and type of room he/she would like to book and then click the Request button.

8.2. The User will be offered a number of suitable accommodations to meet the Users’ needs. The User will be asked to fill in the booking form with certain personal details in respect of the Booking Request.

8.3. The User will be asked to pay for the Deposit (if applicable), the Rent Payment (The Residence Fee is payable in accordance with the User’s Payment Schedule, as outlined in Residence Agreement and depends on either paying full in advance or with Instalments) and Service Fee (if applicable), in respect of the Booking Request.

8.4. The User will receive an Accommodation Confirmation. Acomodile will make an introduction of the User to the Accommodation Provider chosen by the User.

8.5. In using Acomodile Services and accepting any introduction to the Accommodation Provider in respect of your chosen Accommodation, the User agrees:

(a) not to seek to circumvent Acomodile by trying to make a Booking with the Accommodation Provider and notifying Acomodile that you have decided not to make a Booking;

8.6. In using Acomodile Services and accepting any introduction of a User in respect of chosen Accommodation, the Accommodation Provider agrees:

(a) not to seek to circumvent Acomodile by trying to make a Booking with the User and notifying Acomodile that the User has decided not to make a Booking; and pay all commission to Acomodile at the rate agreed between Acomodile and the Accommodation Provider when a Booking occurs.

  1. Confirmation of a Booking

9.1. The Accommodation Provider can accept or reject the booking request. The User will be charged by Acomodile only after the Accommodation Provider has accepted the Booking Request giving rise to a Booking.

(a) If the Accommodation Provider accepts the Booking Request, Acomodile will send an acceptance email to the User notifying that the Booking Request has been accepted by the Accommodation Provider and setting out the next steps;

(b) If the Booking Request is rejected, Acomodile notifies the User and would suggest other suitable Accommodation Providers.

9.2. Once a booking has been confirmed, it is the User’s responsibility to comply with further requirements and the obligations that the Accommodation Provider may have.

(a) The residence fee is payable in accordance with your Payment Schedule, as outlined in your Accommodation Contract and depends on either paying full in advance or with Instalments;

(b) An Accommodation Contract is a legally binding document between an Accommodation Provider and a User, and for the avoidance of any doubt Acomodile shall not be a party to such contract;

(c) For the avoidance of doubt, before confirming your booking Acomodile will advice you about the Cancelation Policy from each one Accommodation Provider you are selected. Notice to cancel your accommodation booking must be given in writing by e-mail info@acomodile.com

  1. Limitations and exclusions of liability

10.1. Nothing in these terms and conditions will:

(a) limit or exclude any liability for death or personal injury resulting from negligence;

(b) limit or exclude any liability for fraud or fraudulent misrepresentation;

(c) limit any liabilities in any way that is not permitted under applicable law; or

(d) exclude any liabilities that may not be excluded under applicable law.

10.2. The limitations and exclusions of liability set out in this Section 10 and elsewhere in these terms and conditions:

(a) are subject to Section 10.1; and

(b) govern all liabilities arising under these terms and conditions or relating to the subject matter of these terms and conditions, including liabilities arising in contract, in tort (including negligence) and for breach of statutory duty.

10.3. To the extent that our website and the information on our website are provided free of charge, we will not be liable for any loss or damage of any nature.

10.4. We will not be liable to you in respect of any losses arising out of any event or events beyond our reasonable control.
